Im just wondering , i have never done it. i mean the girl might want it when shes drunk, but she would think differently when shes sober.

Thats the irony in here, i mean u hear people sayin " i cant believe i slept with him , i was so drunk " or that " i was so drunk i did it with a random guy".
It happens , people do it .
But does that mean that every guy who sleeps with a drunken girl is a rapist ? Legally? If yes what kind of a crime is it when ur partner wants it as much as u do?

But i could still call "rape" and claim that the girl raped and took advantage of me when i was drunk.
My point is 99% of girls say they know what they want b4 u have sex with them , but under what law i would be convicted if the girl claimed that i raped her though we just had casual sex after some party

Having sex with someone who is drunk is certainly not illegal.
But you raise a good point...what if she later on regrets it and calls rape.
Unfortunatley girls change their mind often, drunk or not...
I guess it comes down to communication. If she's too drunk to communicate...leave it alone!
Drunk sexual partners arent that great anyways, unless you only want her to lay there.

If you are going to 'just sleep with her' then no, it isn't against the law ... what you are asking about is the legality of having sex with a drunken female. It's sort of 'up to you' to decide if she is going to remember saying 'yes' to sex and be glad after, or will be so embarrassed that she 'forgets everything' and says you raped her. If I were you, I wouldn't have sex with any woman until I knew that we were in a 'good, lasting relationship' because that is the ONLY WAY you'll ever be 'totally safe.'

I think that's a very fine line... if she's too drunk to say yes or no, then it's definitely rape, but if she's just tipsy I would think she still has the ability to make decisions... I don't really know.

If you think making love to a girl who is drunk is ok, then I think you have answered your own question. If not, which is the right answer, then sober her up and ask.

if shes drunk, she doesnt have the capacity to consent, and therefore cant. so that would be rape. but if shes just a bit tipsy she can consent... but at what point does someone stop being tipsy and start being drunk...?

Not legal in the state of California. There it is concidered rape. I am not sure of the laws in other states.
