No. Only one person can claim the child... by default it is the person who HOUSES the child the most. NOT WHO PAYS for the child the most. BUT, an exception is made if the person who houses the child the most gives up the right to clai the child as a dependent... that is usually done in a written legal letter to ensure that the IRS does not come knocking on your door if your spouse who houses the child the most claims the child on his or her tax return.

Very rarely is there a benefit to filing separately. Are you sure you know what your doing?? If you do that you will probably pay more in taxes than you should.

If you want the feds to audit both of you - sure - in other words DON'T DO IT!!!!

File as MFJ will probably get you a better tax benefit

The person who made the MOST should claim as they will get a good EIC! (earned income credit)sometimes up over $2,000!!
