HELP!!! I am engaged to a fine young man from Mexico. The only problem is that he is not here with me. Is it easiest to marry him in Mexico then file an I-130 or file a fiance visa and wait forever to get him here?? Any advice/comments would be greatly appreciated! I miss him sooo much and can't afford to keep taking trips over there to see him...and he can't keep helping me foot the bills! Thank you SOOOO much in advance!

Puerto Penasco Mexico, go to the beach face north and walk about 200 yards, there is a hole in the fence that will give him safe entrance into Why, Arizona. Of course he will get caught, but its worth the try, if he truly loves you. Or you could move to Mexico, don't you love his country as much as you love him?

people on this board are total idiots. thank the lord i haven't been trapped in some white trash hell hole like some of you obviously have. try getting out of the US for a week or so on vacation. seriously. do you REALLY think all mexicans need to swim to cross the border? really?? people are perfectly elligible to come into the US LEGALLY. legal immigration does still exist you know??? this is what she's asking about!! i'm constantly shocked at how Fi -ing stupid some people in the US are. it's like you've been stuck in a hole and haven't come up for years. there are many many mexicans who have more money than people here will ever have. they're worldy, classy, intelligent, and have a better education than you (that's obvious already)

the girl wants some help because she's in love. and some people here are too ignorant and low class to notice.

so...to you, the one in love.... you can get a k1 fiance visa, or a k3 spousal visa. with the fiance visa, you apply, it's relatively simple. he gets approved, crosses over that ONE time, and you guys get married. you then apply to adjust his status and basically follow the k3 route. keep in mind, with this visa he CANNOT work, and he CANNOT leave. he must stay in the US until he becomes a legal resident. during this time he is not guarenteed to work...so if you guys need money, it will be tough. you can apply for a work permit, but that takes a while.

you can go to mexico and get married, and then apply for the k3 visa. it takes a little longer, and it's more complicated, but when he arrives, he'll be good to go. he can get a job, take trips out of the country, etc..

what i recomend is going to mexico now, and get married on paper. leave him there and come home to start the paperwork. hopefully his approval to come to the US will coorespond with any public wedding ceremony you want to have. you can "marry," have a honeymoon...and no one else has to know that you've actually been legally married for a while except you, your hubbie, and the government. this way it doesn't seem as though you are living without your husband for 5-12 mo.

to me...it's all about trying to start your married life as normal as you possibly can. with the fiance visa, it's impossible to plan a wedding, because you don't know how long it will take. and once you really marry, you two will be totally poor until he can work. with the spousal visa...you can at least try to be normal. just get the legal part of the marriage done and start the process. while you are waiting you can just have all the fun you want planning an actual church wedding with your family, do all the fun bridal parties, etc.. and when everything is said and done, he can come right here with you and you can start your lives together.

I've included a link you can click on to see processing times. It looks like depending which office you would be sending your application too they are either being processed at the same rate or the Fiance K-1 Visa is quicker. One thing to take note of for is that once you have your fiance here as your spouse, he'll be able to apply for Adjustment of Status right away, rather than having to apply for it within a time frame after getting married in the US, so in that aspect, it might be easier to bring him over as your husband. Whatever you choose to do, good luck!

It is definitely easiest to marry there, then return and file a petition for your husband. Any other way could cause him to be deported for up to 10 years. Good luck!

actually you can marry an illegal, legally in most states. i would suggest though marrying him in mexico as i do think marriages there are legally recognized here then apply for his citizenship once he gets a number then he can move here and finish the process. actually here in georgia where i am from illegals are legally marrying here all the time and some still married in mexico and then they are applying for citizenship while being here illegally and there are no penalties...its true! also go to government immigration site or call and ask them what's the best way to approach it. its good though to hear you and he are trying to do this the right way rather than illegally.

sweetie dont listen to any of the retarted comments left by the ignorant americans,,, 2 ways i will suggest is, either pay to get the fiancee visa and wait, which is a lil costly, or go to mexico get married and then file for him to live here, as your husband,,, probably better to do it that way because a fiancee visa isnt that much less, but atleast if your already married, you will have the proper paper work done rahter than paying for a visa and then turining around getting married and having to pay for the papers anyway... total its about $1000,, u have about 800$ in immigration costs, and this is without a laywer if u plan on doing it urself, its better with a laywer but then its about 3000$ but atleast you know its done correctly..... also make sure he has his birth certificate and shot record, because thats going to be important, it also has to be translated into english which is about 200$ and it used to have to be notarized, im not sure if it still does.... hope this helps.... still i think get married and file all at once,,, oh also u have to be worker, because he will not be allowed to until everything is ok'd and aslo because you will have to be his sponsor,, so if u cant be a sponsor for him it prolly wont happen, i had my dad sponsor mine..lol.. good luck hunny

Wow these people are really rude!!!! Racism is written all over you people. How do you know that one of your g-grand parents who immigrated here didn't do it illegally! This is unbelievable!!!

The lady loves the man and they have every right to be together.

To the lady who asked the question, I've heard from people that it really depends. Every case is different and it also depends on where you file the petition (I think that's what they call it).

A friend of mine married a foreign national and his lawyer suggested that he files for K1 visa which would be faster than waiting for the whole green card process.

So his wife got her K1 in 10 months or so, came here then they filed for the green card that she got in 1 year and few months. it's true they couldn't travel overseas to visit her family and all but at least they were together.

This happened some 5 years ago.

Either way, you have to wait for the visa process, either K1 or K3, which both take about 5-8 months.

most Americans now have been Americans for generations. they didn't illegally come here. their ancestors came to America when there were no laws or government prohibiting immigration and all that was needed was a boat ticket to sail.

EDIT3:why wasnt my answer necessary? what did i say wrong? mexicans use various methods of entering the US. his cousins probably have illegally crossed over. look at the last answer. she confirmed that they go through fences. my answer may not have been what she was looking for however, the question was, how can she get her man to the US. i answered the question in my opinion and from evidence of what i have seen myself. i have had the opportunity to converse with illegal immigrants in the past and they were truly looking for better opportunities. i know exactly how most come here and they were not bad people so i am more than qualified to say that most hide in boxes and hop fences. furthermore i have hispanic in my family. so dont spit that racist bull at me. no one is racist. i do not like criminals.
