I was trying on bra's and clothing in a dressing room at Kohls department store and was stopped on my way out stating that they saw me take a bra out of the dressing room (having it on) which was not true. They stated they had a tape of this. I was angry that I had been accused of this. Admittedly, I took the tags off a bra to try on a shirt over it, which was wrong I admit. But put the bra back on the bench in dressing room. Can they tape you trying on undergarments. Yikes!!!

No they cannot tape you while dressing. It is a blatant invasion of privacy. They also are not allowed to accuse you of anything unless you leave the store with the item. You should call their headquarters and complain about the way this was handled.

NO! They definently can not.. Not only is it immoral and a total invasion of privacy it is also illegal... First they can not accuse you of anything because untill you leave the store with something without paying you have not done anything illegal. They violated your rights and acted totaly unprofesional. First you should consider how far you wish to take it. Legaly you have the right to press charges on them for invasion of privacy. I recomend you do because if you let them get away with it they will only do the same thing to others. Do not stand for this!!! Call a lawyer and consider taking legal action. At the least contact the corporate headquarters and get to the bottom of this... You may have been wrong to pull the tags out but two wrongs do not make a right.

From your question, it looks as if they taped you coming out of the dressing room, not in it. They may have gone into the dressing room and found the tag you removed (VERY bad idea) and assumed you had stolen it.

It's illegal to tape people in the dressing room.

I am not sure they are allowed to do that. That is invasion of privacy. They can tape you going in and coming out of the dressing room but not actually in the dressing room. I would call your local law enforcement and report the store.

NO!! And that is definitely a violation. I work for a clothing store.
A) they could get in trouble for falsley accusing you
B) cameras in the fitting room???!!!! WTF

If you didn't do (and you didn't) sue the crap out of them!! You can!

It depends. Ask them for the tape and then send it to me. Then I will decided if it was illegal or not.
