It depends on your states laws and statues. Take a look at the website for your particular state and research the specific law in regards to the charge.

It isn't always as cut and dry as you think. The laws are not the same in each state, nor are the penalties/punishments so it is hard to give an answer to such a question without your states specifics and what degree battery you were charged with as there are degrees to battery and each holds a different sentence. Plus keep in mind most sentences themselves have values, like it can be anywhere from 6 mos. to 15 years, etc, so you would need to know what kind of sentence you would be looking at, at the max, should you decide to take your chances in court,as the final decision of sentence then remains in the judge or jury's hand, depending on who hears your case.

If you beat up a pregnant woman, you should go to jail. More than likely, that's how the jury will see it, as well. If you have reservations about taking 3 years probation versus pleading not guilty and going to trial, you're probably at the point where you should be getting your legal advice from a lawyer, and not a message board.

If you do not take the plea agreement, and go to trial, are convicted, you will likely do time. Generally, if you make an agreement, plead guilty, and save the state and courts time and money with no trial, you get a lesser sentance. If you know you are guilty and they can prove it, take the plea. If you do not, you are guaranteed a harsher sentance.

Your case would probably go to trial. A jury of your peers will listen to the evidence against you, and any witnesses that might be subpoenaed. If they find you guilty, you could serve time.

Take the deal. You could end up in prison for 3-5 years. Alot of times judges get pissed when you force a trial and lose. I'm tellin' you...take the deal.

you would be entitled to either a jury trial or a bench trial (the judge decides the case) and you could be found guilty and sentenced to jail. it depends on the case facts. if the DA recommended probabtion you should probably take it

If you don't take the plea, the case goes to trial. Whatever the outcome from that is won't be known until the jury renders its verdict.

The outcome is what's decided by the judge or the jury at trial.

a trial,up to you if you want a jury or not,can opt for judge trial only but that can go against you,seek lawyers advice not public defenders only,bring witnesses and evidence
