My son is 2 1/2 years old, and I claim he last year, his father want to claim him this year, but his father is still on his own dad's insurance. Is he aloud to claim him this year? We never went to court over anything. What do i do?

even if you never went to court, even if there is no child support agreement..... legally, whomever had custody (and is financially supporting) 51% of the year (at least 6 months) has the legal write to claim the child for tax purposes. if the child lived with you, and you took care of him, you have the right to claim him. you MAY allow him to, but you have no obligation to.

furthermore, if he's still on his own parent's insurance, there's a good chance he's not even claiming himself as a dependent, in which case it's not worth it for him to claim your child.

I'm a single mom and I bust my tail all year to raise my DD. I get child support, but she's with me 24/7/365. I deserve that tax break once a year, and I take it. Period.

whoever the child lives with is who gets to claim the child. Support does not matter at all and insurance does not matter either. If the kid lives with you, you claim the deduction.

Call a tax office, like H&R Block and find out whether you can again or not. If there is nothing in writing, I think the person the child lives w/ primarily through the yr. can claim him.

if he is paying support on the child and made money this year at a job, it might be nice of you...
