I work as a secretary for the NHS. We are expected to cover for colleagues when on holiday but when my colleague went on compassionate leave for 7 extra weeks I covered doing up to 20 hours extra per week. I was told by my line manager I would be paid, but now I keep getting false promises. The work was done last Oct/Nov. Can I claim through the Small Claims Court?

Think your options run in this order

1) Keep trying your personnel/payroll department taking details of who you have spoken to and when.
2) Further advice from Citizens advice bureau.
3) Employment tribunal.
4) Court

I would however make contact not with your line manager but your payroll department first to ensure they have been given the information required in order to process your overtime.

They legally will have to pay you, I hope, it is documented. You can try HR but if they won't help you find out who your ombudsman is. But if they did this to you they probably did it to many others. My husband worked for a company that tried to withhold overtime, but the government found out and they were force to pay a bunch of back pay to not only the ones complaining but everyone else they had not paid fully too. Good luck, don't give up.

The correct place to file the complaint would be your state's labor board ,
I believe small claims is related to merchandise issues and property damage etc.
Call your state labor board for directions.
