I checked on the status of my OK state tax refund this morning and was told that it was being held because of some unpaid bills from 2002! My ex-husband (whom I divorced in 2003) filed an amended return for the 2002 taxes in 2005! I was on the 2002 return with him. Can he file an amended return that was originally filed joint without my signature or knowledge? I'm so frustrated....I have to go thru something like this every year with my state return, something he did while we were married always ends up costing me and not him!!!

Thanks so much for all the help. I've called the OK tax commission and they are looking into the matter. They are going to call me back on Monday after they review the returns.

This is probably stating the obvious, but you need to consult a tax expert - not just an H&R Block person, but a real expert. Although you're generally responsible for your spouse's financial foibles while married, that responsibility supposedly ends when the marriage does; however, tax matters can be awfully complex. (Plus, you don't know what he's telling them.) An expert can help you out of this mess - and help you structure your taxes so that you get the most possible $$ back in the future. (I have a great tax guy that has saved me - and the friend who referred him - many times. He's not expensive, and he's very diligent. I'm listing his name and email address in the source line below, just in case you decide to go that route.) P.S. You can always move to Texas if you get tired of paying state income tax. You need some legal advise from someone who is familiar with OK laws? It would not appear to this writer, that he should be able to amend a Joint TAX return, without your knowledge?
You signed the original and not the amended return, I hear?
The amended return, it appears required additional taxes,
since OK State is holding up your tax refunds, unpaid bills in 2002! You divorced the man in 2003, and the books are still open
on the splitting of that settlement! I would write a letter, if you don't want legal help in OK, to OK State Tax Board spelling out details of your problem! If you split in 2003, I don't see why it would effect "every year with State Returns" but with owed back taxes, penalties, interest, etc. the meter is still running, until settled? Good luck!

A taxpayer cannot change a return from Married Filing Jointly to Married Filing Separately after the deadline for filing.
Report this to the IRS. You did not amend your 2002 return.

Sounds like he forged your name! See if you can get a copy of the amended return from the IRS, and then talk to a tax attorney regarding your options for filing a claim, pressing charges, etc.

You need an attorney. If this was Federal he would be in the wrong and you could sue and if this was here in Michigan it would be illegal too. But the laws in every state are different, check with someone who knows OK law not a bunch of Yahoos.

I'm pretty sure he was supposed to get your signature since you signed the original return. Call the IRS!
