But I find there could be grounds to charge the tobacco company on several grounds, and also the government that allows the sale of such product, of course they collect a fat tax, which supposedly is rolled back into the health system.

IF tobacco is that bad that we have to legislate its use, why permit it at all. They will not let pharmaceutical companies to sell border line drugs that could cure say, cancer, but they let the likes of Philip Morris pollute our lungs and addict our children.
