First, who pays for the daycare expenses? Only the person who pays can take the credit.
Second, who does the younger son live with the most? Only the custodial parent can claim the credit. The custodial parent does not have to claim the child as a dependent to take the credit.
If you (or your ex-spouse) are the custodial parent and pay for the daycare expenses, then you can take the credit. Otherwise, you can't.

His habit is particularly accepted for a newly divorced non-custodial determine, and your emotions approximately it are completely commonly used. i'm particular in case you particularly think of roughly it, you have probable carried out little issues for or together with her because of the fact the divorce which you probably did no longer do until now. i think of that is something that basically occurs subconsciously while we divorce. For besides the fact that reason, we sense the might desire to overcompensate for the certainty that we've disrupted the youngster's abode existence. relax, take a breath and take a glance at to no longer enable it get to you too lots. As you have suggested, that is all new for the two considered one of you. In time, you will all settle right into a rhythm that is mushy... assuming you may proceed to be civil with one yet another. His urge to overcompensate would be overridden via person-friendly experience in some unspecified time interior the destiny, and the 'relaxing dad' weekends will settle right into a greater mundane recurring. basically be attentive to that this may well be a non everlasting area as you the two comply which includes your new relatives. and shop in mind that.... you're nonetheless a relatives, basically of a distinctive variety.

You paid it, you get it. He better not claim it also or the feds will come calling. What does the divorce settlement say about claiming the kids? Who do the kids live with? Remember, child support is not taxable to you/deductible to him - only spousal support.
You need to talk to a tax pro (NOT H&R Block - this is beyond them).

Just by the information you provided, you both can not claim day care expenses on the same child. Your ex can list alimony paid on his return to reduce his income. You would claim the day care expenses.
I don't have all the details so ask a tax advisor.

CHILD CARE EXPENSES ARE NOT DEDUCTIBLE.
If you havw two boys, then you claim claim one boy as a dependent on your tax return and your ex husband can claim the other boy as a dependent on his tax return. But child care epxneses are not deductible.

Child Care is totally deductible up to a particular dollar amount. I am not certain what it is this year but I believe in the 3-6 k range.
Go to this web page and read about it.
