The parent who has the exemption for the student is the one who can take the credit. If your son isn't your dependent, you can't take the credit for his education expenses.

im not too sure about this but there is a new tax paper that comes out sometime this month i know it has stuff about spending money for school. You should look up the new tax stuff on the internet and it should let you know something
