I was rear-ended, and my car needs to be fixed. Do I need to report first to my insurance or to his insurance??

It doesn't matter who you report to it first. You need to report to yours, and he/she needs to report it to theirs.

I have always called both of the insurance companies involved anyway.

BOTH need to know. Absolutely. If you have the other driver's info call his just in case he's a slacker and hasn't done so.

You want to resolve this as soon as possible and you have to show some initiative to make sure it happens that way.

By law and by contract, you have to report it to your insurance company. Ask your insurance company to go into subrogation, which means that they go after the other insurance company for anything they pay you. This way thay shouldn't raise your rates because they didn't have a loss charged against you. Option 2 is to go directly to the insurance company of the person who caused the accident, and ask that they make all the repairs, and pay for a rental while your car is being worked on. Do not sign a release until you have a lawyer look at it. If your rates should go up because of the accident, then you want to be able to sue the other person for the difference in what your insurance costs you because of the accident, if iit was their fault.

I own a body shop. Here's what 2 do. If the other driver admitted fault, you report to his insurance company. They will send an appraiser out to look at your car and pay for the damages. Don't let them force you to use a certain shop. By law, you get to choose the shop you want to use, and they have to negotiate the price with them. Choose someone you know and trust, otherwise you might wind up with a substandard repair. If the other driver won't admit fault, and you do not have a police report, which you should get a.s.a.p., then you can turn it in to your company. Your company will pay the claim & you will have to pay your deductible. But if your insurance determines it was the other guy's fault, they will go after the other insurance company and get your money back for you.
