unless the same parameters are applied to dispense Justice to all,however high or low,the judicial system cannot be said to be impartial.However, as recent events have shown, a strong Public Opinion against gross waywardness in pronouncing judgements against powerful people can persuade even the judiciary to mend their ways towards impartiality.

Well there is lot of talk about 'activism' of judiciary these days. But it is the delay in judicial process that should be talked more.
In fact there is no 'activism', if the power of the legislature is examined to find if it is in the overall national interest at all. To day the politicians are about to sell the country for their personal gains and the hapless masses are just spectators. In the 'enron' case all the politicians made tons of black money, and the public ultimately ends up paying very high prices for the electricity. Unfortunately, here the judiciary also failed to see what happened.
If at all judiciary can be blamed of partiality or selfishness, that is for their working hours. Infinite number of cases are pending yet the judiciary wants to enjoy the luxury of 5 days working. This is intellectual dis-honesty of highest order. A farmer in this country even after working 20 hours a day does not make enough money and is forced to commit suicide, but our honorable judges must have long vacations. I think it is people who should rise in protest against this King Nero type behaviour.

No Judiciary system in this country is good. But population and the cases are more. Therewere urgent and ordinary cases are there. In the judiciary system the judges or the lawyers also human beings. They have also their own thoughts. The type of murders, smuggling, terrorism are varying from day to day. For that they should act according to the book(constitution) and the nature of thing.
Next the ratio of the crimes and police and judiciary is also not sufficient. It should increased.
I proudly say that the judiciary system is doing their duty as impartial.

Judiciary is doing their duty largely impartially. The layman thinks that the judiciary has magic wand to find the guilty among the accused. It is the Executive who brings the guilty and the practising lawyers explain the law and tear apart the evidence or construct a case. The Judiciary has to rely upon the records of the proceedings. Even if the Judiciary tries to put up a different angle he has to justify his stand. However we see a few Justices who have evolved new points/interpretations in law. I would request you respect the law and the judiciary even if you do not agree with them. Yes they are impartial.

The Judiciary in India were to be functioning impartially, our country would have been a much better in every aspect than what it is today. The judges who sit at the seat of legal Justice should be conscious of their divine mission of giving justice and making truth victorious. They actually act on behalf of God who is truth and just! But how many of our judges are godly? How many of them deserve to be called as judges? if our judiciary were to be true to its duty and responsibility, naturally all the crime rate in the country will come down. Many those who seek justice from the judiciary die without hearing the judgement! Justice delayed is justice denied. The very slow working process of our judiciary makes it the most inefficient constitutional body in our country. Those who appeal for justice in the courts as we know loose everything, time, money, health, respect..etc. Let God save our Judiciary!

It is not the judiciary system that is at wrong, but its the delayed justice in our country that is denying justice. Added, several lawyers find ways of delaying tactics to pull on the case for months or years. This loophole in the judiciary system can definitely be looked upon.

Having been in law enforcement for over thirty years....I've seen the results of our justice system do many things.
Sadly, often times criminals "get off" based upon a legal issue that truely has nothing to do with whether or not the criminal actually committed the offense but none the less has an outcome where the criminal goes free!
One doesn't need to become a lawyer or judge to "fight" the system but can EASILY contact representatives on the state and federal levels to voice their concerns!

this is not true when u say all types of criminals escape from our judiciary system .dont be such a pessimist.criminals are punished anyhow.someone is able to make use of loopholes of the system sometimes,but that does not make it completely hopeless.
We should bring changes time to time to make it more effective.thats all....................hasan
