my question is should she file head of household and claim me and my son? will we recieve a return? I did not work. and her net benifit was approx. 7500.00.

Hmm I wish I knew the best answer for you. In my opinion you should do some "test" returns and see if ANY of them can get you a refund. At the very least you can probably get the $30 Telephone Tax refund. Try your mom claiming you both, your mom claiming just the child, and then try you claiming the child and your mom alone on her return. It's possible that doing it that way could get you both at least the $30 refund (hey, $60 is $60). With your income you can both do free e-file so the cost to file the return shouldn't worry you. If you use TurboTax it will walk you through it. I use it EVERY year. http://turbotax.intuit.com/taxfreedom/

Another thing, you probably can't get the Earned Income Credit or the Child Tax Credit if you had NO "earned" income. If you have some income it might help you. Your mom might still qualify with SSA, I am really unsure. As a single parent you are in the perfect tax spot. I make over $30k a year and I always get back more than I paid in... about $4k. I get what I paid in and the EITC and Child Tax Credit. It helps that I have daycare center expense and I get some more to deduct because I contribute to my 401k. My mom also does not work so I claim HOH because even though she pays a lot of the bills (I give her rent and she gets alimony) she can't claim us so she has to claim Single so I might as well claim the HOH.

Just try it out what have you got to loose besides maybe an hours time?

You should have at least said if you were 18. Since you did not, I assume you are not .Therefore, Your Mom will then be able to claim you and your child on her tax return.......Since she is the only one receiving money from SSA. You should call the child support office to apply for child support from the father. The state will pay you until he is old enough to have a job and they will take it from his pay.....Try to finish school if you haven't .....check with the support office on that question.........good luck to all.
Keep in mind, your Mom doesn't get that much in a year. Its hard to live on that little bit.

I don't believe that there is any reason for your mom to file. Her income is from SSA, and she does not have a minor for child care credit. DON'T GO THERE IF YOU BEND A RULE.
