How long would you go to jail for being under the influence of crystal meth?

I would guess it depends on the circumstances surrounding them finding out that someone was under the influence of it. I sure hope that if it you that you can get the help needed to kick that "habit"...It destroys lives! I wish you the best of luck!:)

In California, being under the influence of a drug, Health and Safety Code section 11550, would be 90 days to 6 months in jail and would be a misdemeanor. You could also get a drug program instead that could lead to a dismissal under Penal Code section 1000 or Prop. 36. Otherwise, it's a minimum of 90 days in jail (but some counties let you do jail under alternative means, such as on an ankle monitor). Can't say about other states.

Now, if you merely possessed meth, it could either be charged as a misdemeanor with up to a year in jail or a felony with up to 3 years in prison under Health & Safety Code section 11377. You can also get a drug program instead that could lead to a dismissal under Penal Code section 1000 or Prop. 36. If you happen to be driving while you are possessing the meth, you could be charged as a misdemenor with up to a year in jail or a felony with up to 4 years in prison under Health & Safety Code section 11379. You couldn't get a dismissal under Penal Code 1000, but you could under Prop. 36 if the drug was possessed for personal use only.

I should also mention that the 3 years for 11377 and 4 for 11379 can't be given out right now (unless you agree to it) because of the latest Supreme Court decision that came down a couple weeks ago, but you could get 2 and 3 years respectively.

Depends on the laws of the state your are in. Try a google search on state laws for your state. You should be able to find a website from your state. Once there just look for the crime and it should give a max penalty time.

if it is your first offense you will probably not do any jail time, you will probably be sent to rehab though. Second offense or more, well it really depends on if you have a lawyer or not. Probably some jail time though.

Alot depends on you past record etc. As a cop I have seen lots of people get hooked on "ice", it completely destroys your body and mind. GET HELP
