What do you mean, legal reason? Was it INSURED when it burned down? If so, THAT POLICY IS STILL ACTIVE!!

And . .

If it burned down, there's NOTHING LEFT TO INSURE!!

You are NOT going to be able to get a new insurance policy on "ashes". If it was a PARTIAL, severe loss, like the repairs cost more than 50% of the value of the house, you are ALSO not going to be able to get an insurance policy on this.

Your ONLY hope, is that the old policy is still active. And you'd best have all the contractors under contract, with work under way before the policy expires, as the company will LIKELY not renew it with existing damage.

This is a tough question with you being in Australia. If you were in the USA one option would be to have the contractor take out a builders risk policy in both your names. This type of policy is designed to cover a building while being renovated or constructed and the cost is very reasonable. This avoids you applying for the insurance and may avoid having to disclose the claim since the contractor is applying for it..

Why would you have to borrow money from the bank? Did your previous insurance not cover fire?
