Depends where you are and what type of porn. For example, child porn can get you arrested anywhere. Similarly, if you view porn around or with children you could be arrested. Viewing porn in public (for example a WiFi connection at Starbucks) could get you arrested if others can see the material.

depending on your state and where you are at the time and who's around yes you can. if you are in a public library with minors around you can be arrested for contributing to the delinquency of minors. also it depends on your state's laws on porn and if it's legal or not

The illegality is where you make falseful declaration, or you copy, download for the purposes of distribution. It is against all laws. Unless a legal contract is done and approval from legal department is granted to do so.

Oh yeah. There is a teacher here in Utah who got busted for that. She was caught looking at kiddie porn and now she is looking at 40 years in prison. I say good riddance.
