We have a gun that was given to us by my husband's grandma right after his grandpa's death. Partly in sentiment, and because we wanted a revolver in the house for protection because there is a serial rapist in our area. So, it is obviously not registered to us. If we ever get caught with it in our own home, or have to use it for protection, what would happen to us legally? Also, I like to take it in the diaper bag (in a lock box) when I walk with the kids alone since there are a lot of regeistered sex offenders in our neighborhood, even though it's a nice one. (please don't give me your opinion about carrying a gun, this is not what my question is about!) What if I was caught just having it in my possesion, even though I didn't use it?

The NRA website says that there is registration for handguns in California, but doesn't discuss how that is done.

Carrying a concealed handgun can be a misdemeanor in California if the gun was legally obtained, properly registered, you are not also carrying any knife, nor are you a gang member (actually defined in the statute), and it is your first arrest.

You would be best off consulting a criminal defense attorney. Ask him in hypothetical terms ("if I were to..."), or pay him for his opinion.

Depends on where you are living. Here in Wyoming, your possession of the weapon in your home is no problem. If you want to carry it on your person (the diaper bag is considered to be on your person) you would need a Concealed Carry permit. Not hard to get in this state.
Other states make it very difficult to own, possess, and carry a gun. Check your telephone yellow pages for Concealed Carry classes. Call them and ask about the laws in your state. They should be very helpful.
If you live in a state that requires you to register the gun, you should do so right away. Even though you may never use it, the possession of an unregistered gun carries severe penalities. Same thing appllies to carrying the gun without the necessary permits.

Having the gun in your house is no problem. If you ever have to use it, shoot to kill in your home.
Carrying it in a diaper bag is not wise at all. If caught you can be charged with many different offenses. You can get the gun registered and even get a permit to carry the gun. This depends on what state you live in.

very few states require any gun to be registered. Unless it is bought from a retailer. After that you can give it to anyone you wish without telling the authorites or agencys. Some states are right to carry. In these states you carry it as a sidearm where it is visible to the public eye. If you wish to conceal you will probably need a permit. In other states you will need to apply of a carry permit. Check the NRA website there will probably be info. for your state there. Or a link to a local web site in your state. If you live in Manhattan or D.C. Handguns are not legal.

One important detail is missing here...In which state do you live? I live in Oklahoma where guns are not registered; I could sell you a gun with no paperwork and the police would not have a problem with it. For you to legally carry a gun, you need to get a concealed carry permit. Most progressive states allow law-abiding citizens to protect themselves. One person I noticed stated that "guns are a problem"...Does he want the police to stop carrying them? People have the right to feel safe and secure, and for many of us this includes having our gun on our person.

Not sure where you are from.

I guess your country allows registered firearm at home for safety reason.

As for the sentimental value of the mentioned gun. You can inform police, get a record or report, registered it or .... alternatively bring to their legal department to remove the mechanism and sealed it ..... the gun still can be brought back then.

it is legal to inherit a gun but it would be the right thing to do to register it if this is required in the state you live in.
you cannot be prosecuted for having the gun in the house.
taking it out with you is questionable both from the effectiveness of it(my wife had our gun forcibly taken from her by an assailant and was inadvertantly shot in the hand and head) and from a legal view.rather learn a martial art or self defense.

if its never been reported stolen by the serial# then ur fine ... nothing will ever happen ... nothing will happen if u carry it with u concealed either unless its visible and a cop sees it ... in which case u will be harrassed for awhile and all sorts of warrant checks and serial# checks done before they release u ... and u dont have to register a gun in the united states and u dont need a permit for a gun in the united states ... ive been there and through it multiple times with carrying a gun and having one in the car constantly for years ... been harrassed by cops several times ... but never arrested or charged with anything ... so dont worry :) ... just dont get trigger happy unless ur actually in danger ...

Guns don't have to be registered in most states and owning one is just fine.. but carrying the gun without a concealed carry permit may get you in trouble..Especially if your state doesn't allow concealed carry.

well first off i dont know y your living there. u should probably get it registered to u. i dont know how to. and if the police officers understand about the community with the rapists and all then i dont think they would mind if its not visible. but make sure get registered
