So It is a yellow light, so I proceed to go forward. There is a big semi to my left, which blocks perhaps a third of the intersection. All of a sudden, a driver makes a left turn in front of me, and I try to brake, but can't help running into him. The damage is to my front grill and right headlights, the guy who made the left turn damages his right rear bumper. The police report comes out and says the ruling is 50/50. Is this justified? I believe that I should be less at fault than the guy who made the left turn.

The cops are always full of bs with accident reports. They do them all day long and they are boring. The driver making the turn must yield to oncoming traffic. You had the right of way. Additionally, it's damned stupid to make a left when your field of vision is blocked by a tractor trailer.

If you were not ticketed for the accident I'm not sure anything would show up on an MVR report. I'd presume in most states that's just a record of moving violations. You haven't made a claim or had a claim made against you and you haven't made any misrepresentations on your application for insurance unless you have to fill out some sort of affidavit every year at renewal. I don't see the harm. I'm not an underwriter but I'd think that since this accident happened years ago it probably wouldn't have any effect.

Yup, I think it's fair. A yellow light means "prepare to stop." You should have been ready to stop. If the other guy was already in the intersection waiting to turn, he actually has the right-of-way to clear the intersection for the cross-traffic to proceed on the green.

As long as you didn't run the red light then you shouldn't be at fault. It seems pretty obvious that he assumed you were stopping for the yellow light and went for it. He should of had the yield but I wasn't there to see the whole picture.

You were both at fault by proceeding on a yellow. What happened after that is not taken in to consideration. If you both had stopped there would of been no accident.

Technically, you should always be going at a slow enough speed at which you can stop without hitting someone's rear bumper. Even if someone makes a sudden swerve. It's called defensive driving. Tough break. If you don't like it, take it to traffic court.

Good thing for you cops don't determine negligence. They're only stating their opinion. Insurance companies determine liability....IF what you write is "almost" accurate, then you should be in the clear. However, there are many unanswered questions.....
