My boyfriend won $5,000 at his casino where he is empolyed an was empolyed at the time he won the money. They never gave him the 1099-G form to file for taxes and said they will not give him, proof of his wins or loses, is this leagel. 2 days later he won 13,000 at the bingo palace which is affilated with his place of empolyment, and they never gave him the 1099-G form either. What should we do? I don't understand why they won't give him this form? he lost most of the money back into the machines and they won't give him the stuff he needs to prove this to the IRS or who ever he needs to, Are they suposed to give you a copy of your proof of wins and loses? What should we do about this because they said they won't give it to him.

This is a really messy situation. I will have to assume that your boyfriend is employed at a licensed United States casino because of your mention of IRS forms.

1st: It is probably illegal for your boyfriend to have gambled at the casino where he was employed. That could be the reason the casino doesn't want to acknowledge any wins or losses that your boyfriend may have had.

2nd: The tax form is actually called a W-2G.

3rd: Your boyfriend could lose his gaming license for gambling at his employer's casino. They are both trying to cover up, and maybe you are asking too many questions???

4th: Losing "most of" $18,000.00 in 3 days on machines is serious money. I'd look elsewhere as to where this money is being "recycled." Maybe it's not gambling, and that's just the cover story for you to believe.

Note: The new info you provided is helpful. Did the law that was passed allow employees to gamble at the casino they work at?
I highly doubt it. Probably just at other casinos in the state.
2nd, your boyfriend doesn't need the tax form to claim the winnings on his taxes. Have him amend his return, and state the income. He can then deduct his losses, up to the amount of his winnings.

I think thje reason they didnt give him the 1099-G form was because, he isnt suppose to be gambling in his own workplace. so for him to not get caught, they didnt give him the papers.. a cover up for the casino and him.. well you let everyone know about it.. and i am sure people from the IRS is reading this too.. so you may have blown their cover..

I think they are suppose to give you papers to prove that you won money, then I suggest that you take legal action. personaly this is just a thought, Ive never gambled a day in my life and dont know much about this sort of stuff, just wanted to try to help you. sorry if this is no help.

Have your taxes done by a professional, and they will know what to do about the situation. Did he opt to pay the taxes up front? If so, don't worry. If not, have a professional deal with it. Good Luck-not that you all need it with those winnings!
