I live in an apt. bldg. in NJ & today my Mom who cares for my son while I work, took my 14 month old son for a ride in the stroller in the hallway as she's done many times before. It just so happened that while she was going up & down the hallway, the apt. rental manager came to the floor to show a couple an apt. that was vacant & ready to be rented. While she was around, my son started to cry and make some noise and then the apt. manager ordered my Mom to go back into her apt. otherwise she would call the cops because according to her, the hallway was not a playground & we were disrupting the other tenants. I should mention, this happened at 4:00 pm on a weekday while most people are at work. I don't know much about laws but is this harrasment? Can the cops really do something to me? My son sometimes cries while out in the hallway but it is nothing ear-piercing. He only really cries when we stop the stroller because he likes the ride or when we're about to go back inside the apt

I don't know of any cop who would actually take any enforcement action against you in this situation. It would be different if your child was just running around alone and screaming, but a crying baby is nothing to call the cops about. Maybe when your lease is up you should look for a more kid-friendly complex.

While I don't now NJ law, I find it hard to believe that the police could, or even would do anything to you in a situation like this. It sounds like the Apt. Mgr. was worried that a child, crying in the hallway, might cost him a rental. So, he threw out an empty threat in an effort to quickly resolve the situation...which he effectively did.

Unless there is something in your lease, prohibiting children from being in the apartment, I don't think the Apt. Mgr. has a case. Similarly, I don't think you have grounds for any kind of harrassment claim.

If you are really concerned about this, I would suggest that you contact an Attorney in NJ.

why did your mom just go back to the apt?

this apt...manager..is out to show the apt...and, perhaps,, he told a perspective tenant..that there are no children in the building..(guessing), abviously he didnt want anyone to see your son.

its not harassment...unless it happens on a regular basis...

this apt...manager should be reported to HER boss...

dont get the police involved or the law...start with her boss...and, dont get upset...just state the facts...(because otherwise you will not be heard)...

I think that the apartment manager needs to get a life. There is no excuse for her behavior, and I don't believe that there is a law about babies crying in a hallway. My best advice to you is to move......cause she's gonna be problems in the future. I don't like the idea of her "ordering" your mom back into the apartment. Please consider moving.....this lady sounds like she is an idiot. Best of luck to you.

Sounds like the landlord is being a jerk. Kids are gonna cry at times. The police probably won't do anything other than talk to your mom about it.
