I am a South African citizen, living in the UK. Both my children have British passports. Do they need visas to visit SouthAfrica.

I believe S. A. government allows British passport holders to enter into the country without prior visa for few months. Visa will be granted at the airport. But I would check, if I were you, with the nearest South African Embassy/High commission.

According to South African law a man has rights over his natural child if he is living with the mother at the time of birth and thereafter or even if he has not been living with the mother he has been been supporting the child financially and/or emotionally. He would also have parental rights over the child if his name appears on the child's birth certificate as the natural father. It would seem that it does not matter where the child was born or whether the mother was an illegal alien. That has nothing to do with parental rights. So if he has been supporting the child and/or his name is on the birth certificate and/or he has been living with the mother then according to South African law one of the rights that he has is that he can prevent the mother from giving the child up for adoption or from removing the child from the country without his permission. You didn't indicate whether they were married or not. If they are/were married then of course the man has even greater rights in respect of the child. The fact that the child has a British passport does not matter because the child would also be a SA citizen through the husband by descent. Even if he has broken the law by harbouring an illegal alien that does not affect his parental rights. Even if your sister asks to be deported the man could ask that the child not be deported with her because she is his child and has dual citizenship. This sort of situation has often arisen. Your sister would have to apply to court for the removal of the child from the country. The court in deciding would look at what the best interests of the child are. Which parent takes care of and is able to support the child. Family ties, age of the child etc. She should consult an attorney and if she can't afford one Legal Aid will assist her.

They most possiby don't need visas for SA since they are British nationals. You just have to make sure that they have return tickets, to prove that they will be leaving SA within 90 days.

Check out South Africa's home affairs website in London.

Enjoy SA!!

No, they don't need to apply for visas. They simply need to fill out disembarkment forms for foreigners when they land in South Africa (these are handed out on the flight and are available before you get to passport control).
