can i claim my dependents and get earned income credit?

i am married to an illegal immigrant and want to know if i get earned income credit for my kids wich are not his

Depending, on how much your income is, and if you didn't live with him the last six months of 2006, you can file as head of household !! Your EIC is based on your Earned Income!!
