My ex husband got custody of my children because I missed a mediation hearing. I have supervised visitation! I only have seen them 6 times in 8 months. My daughter is 12 My son is 10, They both want to live with me. I was their main parent for the past 5 years . Right now I am a stay at home mom with my Disabled son (5) from my second marrige we just make enough to get by, a lawyer wants $ 3000.00 minimum for a retainer I don't have that kind of money. I tried going to legal aid but, all they will do is help me fill out paperwork. I am really in a bind! I love my kids and have always been an excellent mother I have never used drugs, been arrested or anything like that I have always been a stay at home mother and Thet truly want to live with me, What do I do Please real answers only. Mother with a broken heart.....

Just thought I would mention that The judge has it in for me. According the the lawyer I spoke to who actually knows the judge personally, he says that Judge Mackey is very particular about people showing up for meetings, or hearings, so now that I missed one I am on the %$^& list!

I dont understand how you lost your kids in the first place for just missing a mediation hearing. Missing something here but anyhow thats not the problem now. You can file the paperwork with the court for a remidification for child custody hearing yourself or with the help from legal aid on the paperwork. You dont necessarily need an atty for this unless you can afford one but you can do it.Once in court ask the judge to allow the children choose who they want to live with. Both are old enough to decide. The judge may then take the kids into his chambers and ask them a few questions and if he likes the answers he will allow them to decide as long as there arent any unforeseen situations to prevent their chosing from happening. You can do this all without an attorney. Good luck

well mabe go back and try to get your ex husband to settel with joint custody cause that's at least a step forward. then you can try to show the judge how much your kids like to be with you and try to convince him that your a good mom and deserve to be with her kids.
