I am paying child support for my daughter and I paid for her daycare costs, which totalled $2,680. Can I claim that as a tax deduction even though I'm not claiming her as a dependent?

thanks to everyone who answered! I took a look at my seperation agreement and what do you know, I get to claim my daughter every year till shes emancipated!

Child care services are not deductible if you are not claiming the child as a dependent.

The person above mistated what the law actually is. Even if you don't claim your child as a dependant you can claim the deduction. However, there are other requirements you must meet, including being the childs custodial parent. The link below sets forth the test and also has information on divorced/seperated, etc. This is not legal advice, but I hope this helps.

transform...., try the link again - I tried it and it worked for me, took me to info on claiming the child care credit. It says that only the custodial parent can claim this credit.

Child support payments are not deductible on your taxes. However, if you are paying alimony, those payments are deductible for you and the person receiving the alimony must claim it as income.

You can claim her as a qualifying child, form 8901. Check that out.
