What is the difference and function of the two when it comes to enlisted affairs? if my battle buddy has a problem with his Reserve Unit the whole chain of command failed him why do they send him to see the IG which is a female who works for the same general in his chain of command who did nothing in the first place.?

Depending on your problem and your chain of command, the JAG may not be an independent source for helpful info. The IG is outside of any chain of command.

The Judge Adjunct General (JAG) works as the local Commanders legal prosecution and team for legal counsel. If a military member needs legal representation, they go to the Area Defense Council. ADC may be located on a base or fort but they do not work for any Base or Fort commander. Their Command HQ is located in Washington, DC. They are totally independent from the Posts chain of command.

If a Soldier, Marine or Airman has tried to resolve a valid problem through their chain of command and cannot get resolution, they can go see the Inspector General. I'm not sure about an IG at Fort level but I do know that IG's at Major Command and Service level IG 's do not work for a local commander. They report to the HQ IG in Washington, DC.

A Soldier or any service member can see the IG anytime but are encouraged to try to get things resolved within their chain of command first. The IG will look closely at the situation and see if any regulations have been broken or persons rights denied, etc. If the case is valid the IG will make a binding ruling and further recommendations as applicable. If your friend is getting nowhere on Post, he can take it up the IG ladder.

Because it is the IGs job to investigate such matters. In addition the IG has direct access to the commanding general. Thus, if the IG feels that the complain has merit - he can go straight to 'the boss' for action.

The IG also serves as: "the eyes, the ears, the voice and the conscience" of the Commanding general. If they get several complaints about similar issues they can alert 'the boss' that there is a problem.

But remember - the IG can only work within regulation. If the regulation says 'X' but you want 'Y' he can do nothing for you.

JAG is for legal action. The IG is the proper non-legal (as in law, not allowable) way to handle problems within the chain of command. However the IG can only recommend, they can not order the chain, but there will be hell to pay (bad OER's NCOER's removal from command) if the person contacting the IG received retribution in any way.

Its the IG's job to handle those matters. Jag has no power over matters like that. If the IG does not help the best bet is his congressperson. If the IG fails to handle it properly a written letter to a congressperson could work wonders. No commander wants congress to look at thier unit. Good luck

im military and as far as i know your buddy should go to IG and report the incident and they by lay umjc have to launch a full investigation about the sittuation the only way that you will gop to JAG is if there was a phisical altercation and the issue is still not resolved if your buddy is a single soilder i would conclude boss in my complaint to get it settled or if you have no luck go for the last rco CA and they will definatly fix the problem,.

Tell your bud to write his congressmen. It is the only way. With the reserves and National Guard is very hard to get any high ranking soldier discipline case in point, the prison scandal in Iraq. We all know that those kids did wrong but their supervisors and commanders should have been held accountable as well.

The Inspector General is a branch that often resolves issues between individuals and their unit's or staff personnel! The place they don't want them to end up is at JAG as that means they have already committed an offense.

So she can advise the chain of command if they are screwing you up and how they can do it the right way without ruining their careers.

if you out rank him especially if you are an NCO (if you were you should know what actions to take) then you can get him for failure to obey a lawfull order violation of artile 92 of the UCMJ. but if he is not in your unit or chain of command what is the reason for you to be concerned with him. dont be one of those soldiers who get a big head and feels the need to mess with people just to mess with them. if your not disregard, but make sure you are in the right and for a valid reason before you pursue this any further. he could get you at the same time for interfering with his duties
