My husband was in a car accident, how long can the CHP, (Calif HW patrol) legally take to finish the report?

I suspect that the hang up is that It was a city detective that hit my husband, and the detective was at 100% fault, so I find it interesting that it is taking so long. It has been 13 days.

The detective was speeding 60+ mph n a 35mph zone.

No the detective was just commuting to work at 6am. Not enroute on a call. Just speeding, came over a hill westbound, lost control and hit my husband going eastbound. He narrowly missed my husbands truck but struck a livestock trailer that he was pulling, totaling it. After that impact the detective rolled his car 4 times, he somehow escaped with minor injuries.

I don't know of any law that regulates time to complete a report. There may be a department policy but that would vary. I would assume it depends on the severity of the accident. I've seen our accident investigation team take 2 weeks to finish diagrams of a fatal accident. If the accident was minor usually takes 7 days to clear for your insurance company to get a copy.

May want to call and see what there reason is for a hold up.

Addition since your last comment: Although an interesting twist to the story I don't see that as changing the outcome of the accident report. If it was the detectives fault I wouldn't worry too much about it. Just curious was the detective's car enroute to a call with emergency lights on? And if so did your husband yeild to the right? ( Also not going to change the outcome much )

It's not abnormal to have a delay in a report when a city vehicle is involved. Just make sure your insurance company is notified and have them do most of the work for you. You pay high premiums for insurance for you to be running around trying to collect reports. Make them earn the money. You'll be fine.

In addition to your comments: I'm sure the delay is the injury part of the accident with the Officer. Once again don't worry about the delay as long as you notify your insurance agency. The administration is probably completing its paperwork for an accident review. Normally these reviews determine if an Officer will get disciplinary action against him.

Obtain a contact person at the department. Perferably a member of the administration with rank so he can keep you up to date as to the paperwork and investigation. Ask when the soonest possible time your insurance agency and attorney can obtain the report.

Yes I did say attorney. Although you may have not obtained one it shows the department you expect results in a timely manner. This may prompt them to give you results fast.. Good luck
