I live in AL where it is legal to go around and hunt through other people's garbage. Every Monday morning the same couple comes through and searches through all of the garbage cans on my street. I've asked them to stop and they continue. How can I get these people to STAY OUT? -If I wanted people hunting through my trash I'd have a yard sale.

1) they are in the driveway
2) I do wait to put them out
3) they aren't homeless or bums
4) I put cat litter and anything rotten on top
5)I know it's pubic domain if it's on the street...that's the problem. There isn't a set pick up time so it has to be out before 8 and they come anytime between then and noon.
6)I have verbally asked them to stay out

In the State of Alabama, once your garbage cans are placed upon the roadway...they are "essentially" upon public property.

To solve your problem, maintain your cans upon your property. When you observe these people upon your property formally advise them they are being trespassed from your property.

Should they return to your property again, contact your local law enforcement agency to file a complaint (Incident/Offense Report). Upon completion of that report, you will be able to file a warrant for the arrest of the subjects for the offense of "Criminal Trespass 3rd Degree" a violation of 13A-7-4, Code of Alabama.

If your property is fenced to exclude intruders, you would have "Criminal Trespass 2nd Degree" a violation of 13A-7-3, Code of Alabama, which is a misdemeanor offense.

Leave the cans on your driveway instead of the road. If they search through your trash while its on your property its the same as them going up to your house and peeking in the windows. You could call the police or take matters into your own hands ;)

When you move you trash cans to the street for pick up, they become public domain. If you want to stop this from happening, Don't put the cans to the street until just before they are collected.........

Throw something away with your trash that is extremely smelly. They won't want to search through a can of moldy food, or animal feces.

Are they hurting you in anyway? Probably not. It sounds like your the type of person who likes to have something to complain about!! Get over it. Get a life.

Dump something really gross on top of your garbage like dog crap or rotton eggs.
