I live in Cleveland, OH and I want to change my son's last name to my last name. He is 3 yrs old and he hasnt seen his father since he was about 8 months old. I heard you need a good reason to do this, and basically that is one of them and his father is in jail for being with a 13 yr old girl and getting her pregnant, so he's in prison for 13 yrs for that, and he also tried to kill me and harm my son in the process. I just want to get on with our lives and get it changed before he starts preschool. I know his father needs to know that i'm doing this, but what if he disagrees, does it matter? And how much could this thing cost?

Everyone was off base on this one, i called and i didnt need to have him sign over his rights, he said no, but it didnt matter, and it only cost 80 bucks to do it, i dont know where you people got 500 bucks and stuff at. goes to show how much this yahoo answers actually helps people.

The biological father does not have to sign his rights away in order to have the child’s name changed. You’ll need to petition the court for a name change. Dad will be notified and given the opportunity to contest. Will the judge approve your request? There’s no way to know for sure.

The biological father has to sign his rights away for the boy. If you explain you only want to put his last name same as yours maybe he will do so if your up front with him like you were here with us. My niece had a little girl while going through a divorce with her husband (now Ex) and because she was still legally married when the child was born she had to put his (her) last name on the birth certificate. After the divorce she married the biological father of the baby and wanted his last name on the birth certificate. When she asked her Ex to sign the papers he said NO! out of cruelty. She contacted the judge that granted the divorce, explained the situation and the judge ordered $600 a month child support from her Ex. He had a fit, said the child wasn't his and he wasn't paying for it and the judge handed him the papers and said then sign her rights to change the baby's last name to the fathers and you won't be responsible...he signed them!

you have to go to court and ask for his name to be changed
they will try to find the father for him to sign off on it
if they cant find him then the judge will make the change

you need to get him to sign off on your child or you cant change it... it costs $500.00 or more... the lawyer can take the paperwork to him, and get it all done
