I got out drinking with a friend of mine...well he insists on driving and drinking so like a fool i join him. But his brother said I could get in trouble if I rode with him and I let him drink while he was drunk. I know he could get a ticket for open intox. but would i get one two? just wondering as we do this a lot and once had to stop for a toll booth by Chicago, Ill and the toll attend. said hey you are not supposed to drink and drive...i thought we would get arrested but we did not..lucky i guess. he does this all the time. this is not a joke or prank question

As an ex-cop, I can tell you this...

You will not be cited or charged, only the one operating the vehicle. But I do question your good judgement getting into a car with someone who is impaired by alcohol. I think your worries need to be with staying alive, not whether you'll be charged with something. Put your priorities in order.

I believe you can only get charged if you own the car, or in some way help him get it

However, if you are in an accident, he will get blamed, even if the other driver made a mistake - and if anyone is injured, both of you will have your names in the paper, and you will share the moral judgement of the community with the driver, if not the actual criminal and civil liability

If you're really a 'friend', you don't condone a habit that can ruin his life, and other people with him. Even a single DUI, if it occurs at a critical point in someone's life, can change the course of their life forever, as the consequences have a large ripple effect. And if it doesnt change their life long term, it still pretty much makes a year go down the drain

like your question, drunk driving is not a prank or a joke - it's one of the most common ways, otherwise law abiding people mess up their lives

# 1 your going to get yourself killed. Never ride with someone that has been drinking.

#2 drunk driving is not a game. How would you feel if your friend hit another car , and killed a a whole family or even one person for that matter, Could you live with that?

#3 I believe you both could be in trouble. If not Im sorry but you both should. Your not only playing games with your life but everyones.
i am 33 years old and I have never ever driven drunk. I know that some dont mean to that just didnt know they were over the limit, however your getting drunk and arming yourselves with a deadly weapon...... your car

Getting a ticket is the least of your worries if you go out with somebody who insists on drinking and driving. You could die. Be the designated driver or find another friend.

In my state, you have committed no offense and cannot be arrested for allowing a person to drive drunk. I would not be surprised if a smart prosecutor could not fashion an argument for "aiding and abetting" the commission of a crime if it was clear you knew he was drunk, but that has not happened here yet. I assume you know you are being foolish, right?

No, you CANNOT get a ticket if you are not the driver, but in this situation, if you are the passenger, you are taking your life into your own hands riding with a drunk driver.

The driver is the only one ticketted when a violation is committed and not including the passenger because he has nothing to do with driving.
