I made a deal with the collections agency, but I cant afford to stick to the deal, I called them and the lady was very rude and would not make new deal with me. she threatened me with court and that I needed a lawer, now they put the payment in anyway and my bank account bounced. I called the lady back and she said if I didnt pay she would contact the DA and that I only had 72 hours to to this.. she accused me of fraud and then hung up again. all the while i was saying i would like to make a new arrangment bla bla bla.. what can i do?

1. Put a stop payment order on the check.

2. Close your bank account as the collection agency has TWO more opportunities to present your check for payment to the bank.

3. Open a new checking account and DO NOT SET UP automatic payments, as you are NOT able to keep your promises -- no matter how well intentioned.

4. Wait for the collection agency to make a move and do not have any more communications over the phone. If they have threatened legal action against you, then all agreements you make should be done in writing to ensure an adequate documentation trail and to ensure both parties have the same understanding as to the expectations of each.

5. Whatever NEW promises you make, if you get a chance to make them, KEEP THEM! No one likes a flip-flopper, not even a judge! It undermines your credibility.

First, put a stop payment on your checks (or change your bank account) so that no more checks or withdrawals go through from them.

Second, send them a certified letter stating what your new payment arrangements are.

if the conversation was recorded by them or you and you told them that you couldn't pay it before it was due then it wasn't fraud. i had a similiar experience with a collection agency and they kept threatening me and told me that they were taking me to court and i said fine then take me to court and hung up on them. they called me again 2 weeks later and apologized and set up a different payment plan so just tell them that you aren't refusing to pay but you can't pay that amount and make them a payment offer and if they don't accept that offer then tell them that they can take you to court and that you will talk to your lawyer about them refusing to accept your payments. that will get them every time.
