I married my husband last nov. I'm the primarry sorce of income. I was wonderning if I can fill head of household and claim my step daughter as EIC.

No, if you are married, your choices are filing joint or filing as married filing separately. Married filing joint has better rates anyway than head of household does.

If you file joint, you'll get exemptions for you and for your husband, and also for your stepdaughter if she qualifies as your dependent.

If your stepdaughter qualifies as your dependent and meets the tests to be a qualifying child for EIC, then you can claim the EIC based on her, assuming you file a joint return. These tests are age (under 19, or under 24 and a full-time student, or totally and permanently disabled); residency (lived with you over half the year), and relationship (you're good there).

If you file as married filing separately, you are not eligible to claim the EIC.

You must be single for HOH. You should file Married Filing Joint. Your income is subject to lower tax rates, and you still get the EIC for your stepdaughter.

You can marry up to the last day of the year, and as long as the date carries the year "2006" in it, you are eligible to file Married Filing Joint.

If your stepdaughter spends 50% of her time in your home and you provide 50% of her care you can claim her and you can file head of houshold. Just make sure your step daughter's mom doesn't claim her also. I know this because my mother in law is a cpa and my husband and I just claimed head of household with a step child. you get more money this way

I am not sure, but I don't think so...I got married in Nov. too, and that was, quite frankly with tax matters in mind....
check on line, it takes some time but you can get your answer or call the irs directly, they try to help you, sort of,,,,emphasiss on the word "try".....when you can through...!!!!

No you must file as married. Head of household is for singles, divorced, or widows/widower.

Actually youn can file HOH if you and your spouse are separated and have been living apart for more than half the year.
