'incarceration in a prison' means a trial has already occurred and the DEFENDANT was found guilty. All defendents are innocent until proven guilty, this is why the defendents are put in the county jail until after the trial.

they can be brought back from prison to be used for a witness in a trial or additional charges and be kept in the county jail instead but that is the only way. Alot of times if their sentence is 1 year or less the judge can let them spend their time in the county jail but anytime over a year they have to go to prison.

If you are a defendant, you haven't been convicted, and could not be sent to prison. There are a lot of people who have been convicted, and are still in jail awaiting space in prison.

As far as i can tell out here anyway.. Jails hold for a smaller amount of time and prisions for a greater amount of time.. its what the sentance is in time for one that determines jail or prison..

Do you not get jailed at a Police station and then charged
and sent to Prison after the Court case, Jail and then
Prison on being charged.........................................................
No, you get jailed charged, bailed go to court and imprisoned
after your trial..............................................................................
