If you are a citizen of the U.S. and he is an illegal immigrant you have to go thru the department of homeland security.
There is this program where you can marry a person from another country, with the condition that he has to be in his country, for about a year give or take while his documents are under submission.
For more information you can try a petition to file documentation for a relative. I-130, it take a fee to fill out the application and most of all time.

Just bring both birth certificates to the city hall and any other id's. Legal or not you can get married. If he is illegal though, make sure you contact a lawyer and file all of the appropriate papers needed. You/he will then receive several different letters asking him to have finger prints taken, give him a work authorization card, he can get his SS#, renew drivers license and finally immigration will call you for an interview. I am a sponsor for my husband. It has taken us only six months to get this far. Our immigration appointment is set for March, I am so excited. There will not be any problems at city hall, especially if he has a state ID card. They will also let you marry if he has only a passport from his country, even if he has become illegal. My husband and I got married with him using his Italian passport as photo ID, as he was illegal at the time. The problems begin once you try to get his papers in order. I hope for your sake he has entered the country legally, it is that much easier to get his papers even if he is now illegal. If he has entered the US illegally, you will have a much lengthier process for him to get a green card. Best wishes!

should check out the government office or website to see about citizenship. but if he isnt a citizenship then can still get married but i believe it will take about 6 months for the country to reconize it. pick up a marriage license and ask them about it.

If he is already in the country legally, you don't need any further documentation. If he is not, you had better make a call to an immigration lawyer first and get him legalized/naturalized prior to getting married.

He sounds as though he might be illegal. With the debates going on right now with illegal immigration...don't.
Wait for him to get his papers and what nots in order. This will save you a lot of headache in the future.
Not being mean. Just trying to look out for ya. I would make sure that he had his affairs in order before making a commitment like that.

7 years and all of a sudden decided to get married and you have not looked into any laws. Sounds like a problem to me. He might even be married where he came from.

You´ll both need your birth certificates in order to get married. They´ll still marry you even if he is illegal but in order for him to become legal he´ll have to go back to his home country and wait while you file "Petition for Alien Relative" (Form I-130).
