You are "in charge" of fixing your car. As for the insurance, it depends on your state. Some states, like NY, are no-fault states. So regardless of whose fault it is, each party is responsible for their own repairs to their vehicle. As for submitting a claim to your insurance company, you need to send the police report and most likely a written report of your version of the accident in to your insurance company. They will then review and advise. You will have to pay at least the deductible amount on your policy.

the guilty party's insurance company should be handling the claim.
If your insurance company does not answer the phone, I would get in a car and go to their main local office and see what's up.. pronto! You need to know if they're still in business!!! LOL.

Seriously - call everyone you can possibly think of and raise a big stink. The more you make yourself heard, the more attention and service you will get. They may be pissed and complain about it, but they will get the job done.
