GRAHAM has been lawfully arrested for an assault in which he punched a neighbour. The matter has been investigated and a charge of common assault is being laid. What should the charge outline in relation to the offence?

A Assault and battery.
B Assault by battery.
C Assault or battery.
D Assault by beating.

i think the answer is b, but i am not sure.

hey thanks for your help guys,
i realised my mistake
the answer is a, because assault and battery are seperate offences and hence you cannot have assault by battery.
btw im not from the states, im from the uk

Your answer is definitely "A".
Assault is merely making the attempt of injury, whether contact is made, or not. This is why merely yelling at another person, or using threatening language is considered to be assault; its' the intent, not the act.
Battery is assault when physical contact is actually made, no matter if it is merely touching another or a blow that actually results in injury.

Well, the defense lawyer could bribe the judge and you could get by with simple assault which you did not list. Otherwise I'm all for assault and battery. But then again, were you provoked? If so, the charges could be dropped if you have a witness. But you and I both know that fighting neighbours amounts to stupidity.

What jurisdiction are you in? Most jurisdictions use the charge Assault and Battery, but others break them down into two seperate crimes/charges. Most commonly the answer will be A.
