GRAHAM has been lawfully arrested for an assault in which he punched a neighbour. The matter has been investigated and a charge of common assault is being laid. What should the charge outline in relation to the offence?

A Assault and battery.
B Assault by battery.
C Assault or battery.
D Assault by beating.

i think the answer is b, but i am not sure.
please can someone confirm whether my answer is correct, if not then please could you direct me to the right answer

The correct answer is "B"! Most states have laws of which involve different levels of assault.

There are simple assault where just a threat of injury occurrs and more serious offenses for which some states have assaults by an actual physical contact or "by battery."

My own state has Assault(s) in the 1st, 2nd, and 3rd Degree, of which the 1st and 2nd degrees involved physical contact.

I think it should be assault and battery. Assault comes from the threatening behavior of Graham, the battery part comes in when he beat the guy, so this is assault and battery.

Depending on your State but in Cleveland, Ohio it is Assault and Battery.

Apparently it is all one in the same with no difference except in semantics. Or possibly the use according to location or state.
