It is being recommended that she be charged with vehicular manslaughter. This is a misdemeanor offense, which carries a maximum penalty of one year in jail and a $1,000 fine. It is less serious than a felony charge and means that prosecutors must determine that the death did not result from gross negligence.

Prosecutors could decide to charge Brandy as recommended, suggest that the District Attorney's Office file a more serious charge, or dismiss the matter altogether.

Most likely the charge will be dismissed or she will be fined $1,000. This does not mean that Brandy will not face a civil lawsuit. Civil lawsuits are often brought after the fact and, regardless of what people think should be treated leniently in the criminal courts, can often end up being suits for millions.

Going to jail? We do not know even if she will be charged.

Either way, "Innocent until proven guilty"

If, charged:
The D.A. will have to prove that she was negligent. If, so, the judge will then give a sentence, based on her record.
She has no priors, according to new reports.
But, don't rule out her lawyers, she can afford some good ones.
It is not necessarily about getting away with it...it could have been a genuine accident. But, her speed at the time, is the issue. If, she was going faster then the flow of traffic, plus a history of speeding, then it will count against her.

Civil damages:
Well, that is between insurance companies, normally. But, the family can take it further, because of the death and sue for more, retaining a lawyer, but again that is what her insurance company is for.

Naturally, the family members would want "justice" (revenge) but we are a civilized society, which is why they would never be allowed to sit on a jury for this case. And we are past that whole 'eye for an eye' crap.

Plus, if you are religious, wasn't it God's will? And, if you don't believe in God, people die, check out the statistics, wrong place at the wrong time...Karma's a b#tch!

In Brandy's case this is involuntary manslaughter and with saying that she will be charged with a misdemeanor charge of vehicular manslaugter, which is a misdemeanor, not a felony, felonies you get serious time for, tickets and such fall under misdemeanor, so she will probably just get a fine and some community service, lol her celebrity won't allow her to go to jail, even if it were a regular person they probably wouldn't go to jail because of how this incident, it wasn't voluntary manslaughter(i.e she was on the highway looking to kill someone with her car)

Maybe I'm missing something, but where do you get that she's getting a year? Her case hasn't even gone to trial. On top of that, the crime of manslaughter is punishable by a MAX of 1 year. That means she'll probably get off on probation, assuming this is a first offense and/or she has a fairly clean driving record.

she lives in California. That is just a bad law state. Almost everything is illegal and will get u sent away for a year or more.

She was sober. She was driving in a state that has some of the worst traffic on any highway. People there don't care about the fact that she has a family and it is bad enough to hit someone but to hit them and kill them is something that makes you never want to drive again. This was an Accident. EVEN IF IT WAS MY FAMILY MEMBER IN THAT CAR I WOULD STILL KNOW IT WAS AN ACCIDENT AND AS LONG AS SHE WAS SOBER AND NOT ON ANY DRUGS IT WAS NOT INTENTIONAL. DEATH HAPPENS.

If she was convicted of manslaughter, then the evidence showed beyond a reasonable doubt that her negligence or carelessness caused the death of another. If it was my family, or someone I loved, I would be angry that she only got a year. I know she is your friend, so you will take her side, but try looking at it from the other side for awhile.

because driving recklessly and commiting the death of a person by doing so is against the law and punishable. I cant see why she's getting of with ONLY 1 year. And you'd damned sure want to see her going to jail if she had of killed any of your family because she wasn't payin attention to the traffic.

Involuntary Manslaughter is when you kill someone on accident but they can still prove neglect . She has not had he day in court yet so she has not been sentenced to anything as of yet.

If she killed someone, she's lucky to get off with only a year. Just because she wasn't drunk doesn't mean she has the right to be careless and take a life.
