My neighbor works at Boeing fulltime but works as a reserve police officer on the side. Tonight as my husband was leaving to go to work, the neighbor shined a flashlight in his eyes. My husband stopped the car and the neighbor said to him, "If I can hear your music within 50' of my house then it is to loud. Do it again and I'm going to write you a citation". Yes, my husband probably does play his music in the car a little to loud, but the neighbor has to listen to it a whole 5 seconds until my husband is down the road on his way. The way he popped out when my husband was leaving, it was almost like he was just waiting for him.
My question is, can he actually write him a citation when he's not on duty and being that he's only a reserve officer? I feel that if he's not on duty, then he just needs to call the police on us like anyone else and let them take care of it.

The neighbor is a real piece of work, let me tell you. Walks around acting cocky all the time. It all boils down to this. He's just pissed off because I called animal control on him a few weeks ago because he left his dogs outside all winter and one of them was limping around on a bloody foot.

He's not married anymore. His wife left him about a year ago and he's turned into a totally different person since then.

IT SOUNDS TO ME LIKE YOUR NEIGHBOR HAS SOME ISSUES WITH HIS EGO . AND IS PROBABLY ON A POWER TRIP OF SOME KIND , BECAUSE YOU HAD THE DECENCY TO REPORT HIM FOR NEGLECTING HIS ANIMALS . CHANCES ARE IF YOU SWEAR OUT A COMPLAINT AGAINST HIM YOU PROBABLY WILL NOT BE THE ONLY ONES THAT HAVE SEEING HOW WONDERFUL HE SOUNDS SO FAR , BUT MAYBE YOUR COMPLAINT WOULD BE ENOUGH TO SWAY HIS SUPERVISOR INTO MAKING HIM CHILL OUT OR BETTER YET CANNING HIM.

I would seriously suggest reporting this sociopath with an "accoutrement" problem (I hope I said that pc enough for YA). First of all, reserves are basically at the rank of security guards. They reinforce, they don't enforce. In order for him to write up your husband, he would have to have a full duty officer present. There might also be time constraints, like if your husband is playing his music before 8 pm, or after 8 am, there really isn't a lot your schmoe neighbor can do about it (the times vary per city...check on that as well).
Call the Chief of Police and tell him/her about the incident. Let him know that you felt it was a form of intimidation. I don't think your neighbor will be reserves for much longer.
By the way, I know a man who did something similar, and he was a guard at a local prison. A woman cut him off and so he followed her. He told her that he was in law enforcement and found her actions reportable. She reported him, and he got fired.

Sounds like a guy who is a reserve cop trying to play wanna be. You need to keep a black book on the guy if I were you. If you have a cam, set it up somewhere where you can have your husband leave again in the morning and see if he pops up. Cause in the film, if your husband gets in turns on the radio and then the guy pops up, you have proof that he is stalking.
He can not write a citation. But dont take chances write it down. I would call the police too and then ask the police if the guy tries to write you a citation if you can file a complaint. Seems like the kind of guy that beats his wife, you report him, and then he is pissed off cuz you called the cops.

I don't know what State your in but, this piece of work is over stepping his authority. The problem here is this;The power drunk neighbor is exactly that, "A power drunk", He gets his kicks by making sure that you and your husband are aware that He's the one " In Charge". My suggestion would be this; Place a video recorder just inside one of the closest windows to the driveway of your home so the next time your husband leaves, you get him on VIDEO!! also, tell your husband to buy or borrow a small digital voice recorder and place it under a thin shirt, hanky, (you get the idea), and have some friends over to witness this jerks behavior, Plus; the jerk won't be able to pass up a chance to sound off, or assert his hunger in front of your friends, let him mouth off and get it on tape. Then take a copy of this tape to the Mayors Office and one to the I.A.D. (Internal Affairs Division). Now here's the problem, Is this guy such a jerk that he would have one of his police buddies start harasseing you? or will this SHUT HIS FAT MOUTH!!!?.
The jerk has no business in law inforcement if it " GOES TO HIS HEAD "!!. Just a suggestion. GOD BLESS/GOOD LUCK!!

I've been a District Court Clerk for 9 years, a auxiliary officer harassed my daughter. I called the Police Chief and talked to him. They don't have the authority to write a citation unless another officer is with him. This guy was reprimanded and he never bothered anyone else. Do call the Police Department or Sheriffs Department and talk to the Chief or Sheriff. Remember they work for you as a citizen.

He can write you a citation, but it would be very unprofessional on his part. You would have to take him to court and talk to the judge about the whole situation. You did right by calling animal control. He just sounds like a very rude person. BTW is he married? If not, he is jealous that he does not have a women, and abuse you and your husband to get at society. Ever watch the office? You should because there is a character named Dwight that's on there. The guy is crazy!

Typically a Reserve Police Officer does not have police powers unless they are under direct supervision of a sworn or certified officer. HOWEVER...anyone can sign as a complainant on a traffic or appearance citation.

No, a reserve officer can not go about issuing citations on his own time or schedule. Unless he is working a scheduled event he has no authority. He should be reported for abusing his position as a reserve officer.

i agree with the others. i would call your local police department and tell them that you are feeling threatend. i would also ask about what the noise control regulations are in your city, not every city has a noise ordinace.
Quite honestly the best way to defeat a bully is to show that you refuse to be bullied, and you can to that by reporting him to his superiors, and if that doesn't work out there is always the local news crew... sweeps is coming you know, and nothing gets them more excited that to report abusive behavior of the local PD.

Call the police, ask to speak to the watch sergeant or watch commander, and report him as soon as possible.
The last thing you need is an idiot like that harassing you. His reserve coordinator should put a stop to that, or better yet, pull his gun and badge. People like that make all cops look bad.
