If there is a law, who made that one! How does it read? Any and all answers to this quesion would be great. Thank you

So everyone that I see working in Taco Bell, mowing lawns, backhoe work, trimming trees, etc, is legal?

So according to the first two answers everyone working in the USA is legal? Then what is the problem? Come on they are hiring illegal imigrants and we know it, and you know it. Dont do business with these companies and that would put a stop to it.

your right. i don't do business with any restaurant or store that has illegals working for them. most of the illegals tells you if the are illegal or legal. i never herd of that law. report all illegals.

So the law is the Constitution. You are protected from illegal searches. Unless you have probable cause to believe someone is illegal, you can't search or interrogate them. Just looking Mexican and speaking Spanish is not probable cause.

In the context of applying for a job, there are protected classes and you can't ask questions about those either; things like national origin, ethnicity, sex, marriage, age, etc. That's the civil rights act. Now after they get the job you can ask them things pertaining to employing them like social security number.

Addition:
I didn't say everyone working was legal. If they are illegal and working here that means the employers are breaking the law as well. I just answered your question as written.

None. Employers are required to make all employees provide proof that they are legally able to work in the United States and INS can ask workers and employers to provide that proof.

Edit: Not everyone working is is 'legal" some employees provide forged documents and some employers don'y get the proof they are supposed to get or provide forgeries themselves. And I'm pretty sure INS can do random checks as long as they don't do it in a discriminatory manor.

In the abstract the "unreasonable search" provision may apply, but I don't think there is any law that's specificly says that you can't ask some one if they are illegal. But you or the police can certainly not go up to people on the street and ask them just becuase of the way they look. The police certain could check out people in those places where worker's line up for day jobs...

the law that protects these illegal immigrants from illegal searches is the same law that protects YOU from illegal searches. protecting the rights of the least deserving is what also protects the rights of the majority. be happy you live somewhere that the government can't just bust down your door.

just because you are lucky enough in this particular situation to not be the one under question does not mean it will always be this way. what if tomorrow someone accused you of being a terrorist? ...with NO proof whatsoever. the same laws that protect these immigrants keep the FBI from busting down your door and throwing you in jail.
