my ex and i still live together, i have primary custody of all 3 kids. i make 50,000 a year and he makes 20,000 a year. how should we file taxes to get a larger refund?

You can file as head of house hold and the ex files at single. Since you have primary custody you can claim the three as your dependents. Or you could get creative, and give him one of the deductions. You probably want to find a creative tax person.

Normally the one with the higher income would file as Head of Household and claim the children's exemptions and the other would file as Single.

Your income may qualify you for the EITC and you may not need to claim the children as dependents to get that.

See IRS Pubs 501 and 596. Figure out which way is most beneficial to you as a unit financially and file that way.

You file Head of Household, he files single. As far as giving your ex-husband the right to claim one of the kids you don't have to find a creative tax consultant, you just sign a Form 8332 giving him the deduction and saying you will not take it.

If you're divorced, with custody of your kids, YOU should file single, head of household for the max refund.
