My mom just got a subpeona to go to court next week and the letter said that she could face up to six months in jail and a $1000 fine and to be prepared to pay when she arrives. can they take her directly to jail from the courthouse?

Probably... but they might not do it if she pays the back taxes and fines. Maybe even some court fees as well. It's possible they would give her bail, but if she can pay bail then she should have paid the taxes... so I guess that wouldn't be an option. She might have to have a pretty good story as to why she didn't pay taxes for 5 years. Let's just hope she is up to date on her federal taxes because THAT you really don't want to mess up on.

It's hard to say exactly not knowing what state and city you are in.

Tax evasion can be punishable by jail time and a fine. Thats in addition to paying her taxes. A five year delinquency is pretty serious. Why on earth did she not pay her taxes for so long?
She should go to court and have a really good reason for not paying these taxes. Then she should ask the judge for a payment that will be satisfactory to the city and affordable to her. If she goes to jail, she will probably lose her job and her taxes will never get paid.

Yes, it is possible. There are some options you don't give enough information about, though.

1. You don't say why the city claims she ows taxes. Is this a tax on a vehicle? If so, has she owned it the entire time she's being taxed for?

2. Is she able to pay the tax before she goes to court? Many courts will let you off with a slap on the wrist and charge you court fees if you have already corrected an oversight (like happened to me when my truck's license plates expired).

3. Is there a public defender's office in your area? She would probably be smart to go to one and get professional advice, before she goes to court.

Yes. But, I'm sure they will work out a plan for her to pay the fines if she wants to. They don't want to lock people up unless they have to, it means that not only do they not collect, but they have to support the debtor as well.
