i was in an accident in california, i was blockin someones way out of a parking lot so i reversed to let them out , the car in back of me kept moving forward as i was reversing? so who is at fault? me? him? or both of us?
* they were also drinking and didnt have proof of insurance present?

If you're reversing and involved in an accident, you are at fault. Always.
It happened to me when a buddy saw I was leaving and he pulled in behind me to get my attention (Basically he cut me off). I dinged his Corvette door. It ended up costing me $1,600.00.

Now- in some situations that should have had time to take an evasive action (aka braking and honking) but you are DEFINATELY the most negligent of the two.

The fact that they were drinking and had no proof of insurance has nothing to do with liability. Those would be two criminal issues that the cops should take care of.

no its there fault they should have been keeping an eye on the road in front of them, hence they would have saw youi reversing.
and then they would have intisapated your actions better.
the only thing that is bad is they dont have insurance so you can not claim for the damage to your car
