i was fiddling around on taxact.com and i think the way i understood it was that even though i couldnt claim my son as a dependent that i would still qualify for the earned income credit,am i misunderstanding?

I doubt it but I don't work for the IRS , ask them . . .

Yes, you sure can.
I was in the same situation. My ex-boyfriend was given the dependency exemption for our son in the support aggrement. Since our son lived with me, I claimed him for EIC.
Luckily, I had found out after modifying the last order, he had never used our son as a dependent. So I got to go back and amend the last 3 yrs and claim the exemption.

What an idiot!

Yes, it is possible to still get EIC for your child even though the exemption is claimed by your ex.
