OK i've been on medical leave for 5 weeks. My leave expired 6 days ago. I had carpel tunnel surgey on both hands 8 months ago and it was returning. I was aslo starting to have severe panic attacks on top of other various health problems. The hr guy said i had to have my doctor to state that I couldn't do my present job before i could be transfered. The only option i had then was to take a lower paying job. I just couldn't have went back through the workmans comp light duty torture thing at the time and asked for medical leave. It was granted but i didn't go back in the date i was supposed to due to anxiety, depression and other things. Am i fired or do i have any recourse given what i've wrote here? Thanks in advance

It really depends on what your company policy is. If your doctor feels you are unable to work at all he should write you a notice for HR stating so. I would check with your immediate boss or an HR representative to see how they handle those situations. If you were a good employee sometimes they are very understanding and hold positions.

Try to go back to work right now, if they refuse you, then apply for social security disability (apply for state disability also as it is faster). If you are really disabled you can live on SSDI and you get healthcare with medicare and medicaid
