My former employer RBS insurance will not realease my P45 after i left the company at the beginning of December. I resigned in the beginning of November but because of the shambles of a HR department they have not sent my P45 and will not despite me ringing them at least 3 times a week. When I call they have no record of me resigning or my phone calls.

Could someone tell if I can legally demand thet they send m P45 now.

You need your P45, it is a record of how much tax you have paid and how much you earnt. The only way your going to get it from this company it sounds like, is by forcing them to act.
Ring the Inland Revenue Helpline number, tell them the full name and address of the company and find out the company's tax office, i.e. the department of the IR that deals with employees working at this company.
The IR will contact the company, and tell them to send you your P45, if they fail to do this the company can be fined. That should sort them out good and proper! Good luck.

Well, Daka,
Your former employer is totally in the wrong.
I don't know what thier reasons, or even thinking is.
Your P45 is your proof of taxation etc, and belongs to you.
I would continue to make a fuss about it.
If someone chooses to leave my employ, for pastures new, then fair enough, and ensure that person immediatley receives an up-dated P45, or P60 as applicable.
It is my legal and moral duty to do so.
So indeed, you are correct to demand that important document.

send them a letter stating you would like your p45 back send it recorded delivery so they cant say they never received your letter or you can go to citizens advice and they will tell you what to do but if you start a job in the meantime your new employer will send for it also.

by law they are obliged to issue you with a p-45. try www.businesslink.gov

sounds like they're messing you around, but you can request another at the IRS
