If I'm a private taxi driver in newcastle and drive to london, in my taxi and take my plates off but forget that I've taken them off and take a bus/taxi lane in london and get flashed, can I appeal in saying that I am a taxi and have a valid taxi license, but for newcastle will I get away with it?

Sorry, get the cheque book ready. You have no excuse in law I'm afraid. Your vehicle was not a taxi at that moment, it was a private car on private business.

First, two points of law.

1. The word "taxi" is not a legal term. What we (the public) call a taxi is either a "Hackney Carraige" or a "Private Hire Vehicle". The first can be hailed in the street, boarded at a rank or pre-booked. The second can only be pre-booked - usually by telephone to the cab office.

2. Every bus lane is governed by a Road Traffic Regulation Order. The Order specifies, inter alia, the classes of traffic that might use the lane in question.


From memory, bus lanes in London are restricted to local bus services and, in some cases, hackney carraiges.

So, I think the possibility of you evading a letter from TfL is remote. You might now even find TfL informing your Licensing Authority in Newcastle if you try to appeal their letter.

My advice - pay up (and be more careful next time).

I wouldn't have thought so because if you were using your car as your own private transport, ie you didn't have a fare on board, then it wasn't technically a taxi and if you did have a fare on board then I would imagine taking your plates off would contravene some taxi regulation or other.

Firstly, I assume you are Hackney and not Private Hire?
I think you will find that you are only able to use bus lanes in your licenced area.
If you leave that area (Newcastle) then you are just a "normal" vehicle.
