My roommate was arrested this weekend for breaking three car windows in front of a house party. There was no theft attempt, he was just really really wasted. Apparently he blew a .29 bac. I know this guy, he really is a genuinely good dude, but he was completely blacked out and broke over $800 worth of property. In 2002 he got his 3rd dwi, but has been without incident with the law since then.
He is a student in college here at the University, is a 3.0+ student, has an internship for marketing and has a lot going for him.
He was charged with felony criminal damage to property. I am going to say a few things on his behalf in court and ask that he can be put on probation and put in some sort of alcohol program. I'm really scared for him that they are going to put him in jail and he'll have to drop out of college.

I am wondering if the judge would have some leniancy and let him repay everyone, pay a fine, and plea bargain to a lessser crime providing he stays sober? Thanks.

Especially with three DWI's, at least two of which are probably felonies, a sicko booze junkie like this deserves no leniency, and I personally hope the judge throws the BOOK at him and he does some REAL HARD TIME, as well as having to pay complete restitution for the damage he did, even if the authorities seize his own property and sell it at auction, as he certainly appears not to have learned a Damn thing, and probably never will!
I lost my left leg, as well as any real hope for a decent quality life, to a drunken slob like this in a DWI over fifteen years ago, and have been forced to live in constant pain EVERY DAY since, which no punishment that can be meted out by a court could ever match, whereas the worthless junkie cu nt that did it to me only served 24 months out of 4 1/2 yrs. on drug charges, and NOT ONE DAY (technically) for almost MURDERING ME! This beatch blew a .17 FOUR HOURS after running me down, while MINE was .00! ! Adding insult to injury, the sl ut didn't have a DIMES worth of insurance, either, which means I have been forced to live in abject poverty for the last 15 years, as well! ! !
Every drunken bum or junkie who has so little self respect or respect for the lives and property of others DESERVES all the punishment the courts can heap upon their worthless lives!

It's Probably Unlawful Mischief- felony. That means the damages were over 1000.00. I agree with the guy above. Butt out of the roomates business. remember, you go shooting your mouth off in court and its your reputation that gets trashed if he does something stupid again. It's all up to the Prosecutor. He may do some jail time. possibly probation. He will pay restitution and he will be fined. If you want to do him a favor, tell him to get a good attorney and try to bargain this down to a misdemeanor charge of Unlawful Mischief, anything under a felony.

He should try to sign up for and "IN patient" program. Its probally the only thing that will make a real difference in his life. A judge may go along with such a program is subsitute to jail. But he will have to submit to drug testing and such. You must keep in mind though, He will only quit if he wants to, its really hard, i know from personal experience. I haven't drank in 5 1/2 years. Im 27, but anyway the way i quit for good was to make myself the promise that i wouldn't. Sounds stupid, i know, but most people have never kept a promise they made to themself. I never had, all the AA meetings and groups drove me nuts. I personally couldn't agree with the basic principbles of the program. That however doesn't mean that i dont value what I learned in the program. I just found what has worked for me. He definately should get involved in a treatment program before he makes a mistake he can't recover from.

Based upon 30 plus years of law enforcement:

1) The judge will order restitution!

2) The judge will order probation until full payment of restitution.

3) The judge MAY order drug and alcohol rehabilitation.

If you are a good friend...it's time to sit this fellow down and tell him about respect not just for others but for himself as well.

Here's a "marketing" tip for your friend:

If I'm the consumer, knowing that this world is seriously competitive, would I bring my business to he or his company knowing that their actions MIGHT compromise my investment?

No!

Get beyond the college antics and properly prepare for life!

It's my opinion your buddy needs an attorney. He's already been busted 3 times for DWI and now he has Felony charges against him. The courts might not want to do this guy a favor unless he's got himself a fast talking attorney. It won't be cheap.

riggghhhhttttt....he sounds like a "really nice guy" with a booze problem...let him handle his own trouble, maybe it will wake him up.....
