per the instructions for the EIC if either you or your spouse are under the age of 25 or over the age of 65 you are not qualified to claim the EIC

The Law states that if EITHER you or You spouse are over the age of 65. you do not qualify

It depends on how much you made. I'm assuming you don't have any qualifying dependent children. If you don't, then you might qualify for EIC if your earned income was under $12,120. There's a worksheet in the 1040 instructions you should fill out to see if you qualify.

The IRS rules on age are as follows: "You must be at least age 25 but under age 65 at the end of 2006. If you are married filing a joint return, either you or your spouse must be at least age 25 but under age 65 at the end of 2006. It does not matter which spouse meets the age test, as long as one of the spouses does." This is taken from IRS Publication 17. So the responder who says you can't take it because of your husband's age is incorrect.
