I have had no income this last year. Due to medical reasons. My family wants to claim me as a dependant and my new daughter born last year. I see no problem withthis as they have paid my bills taken me to Dr.s appointments and many other things. But, I owe child support, of 500. I am wondering if anyone in the family can claim me, and my daughter or is there certain criteria that has to be met before you can claim someone as a dependant?

who ever takes care of whomever has the prerogative to claim the dependents. if you owe child support pay it when you get your return. call the OCSE in your area and let them know you owe child support. but how do you owe support if the child is with you??? email me direct. I deal with this situation, so I am kind of knowledgable with the OCSE compliance laws to some degree anyway.

Do you live with the family member who wants to claim you? And does your daughter? That will make a difference.

If you don't live with them but your daughter does live with you, then they likely can't claim your daughter, but might be able to claim you as a qualifying relative if they provided more than half of your support.

If you lived with your parents or a sibling for at least half the year, and your daughter lived there too from the time she was born, then that person might be able to claim both of you as qualifying children.
